1. Agreement to Terms

By accessing or using TreatsMe ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all users of the Service, including business users (service providers) and end users (customers booking appointments).

2. Description of Service

TreatsMe is an online booking platform that connects service providers (such as barbershops, beauty salons, and other businesses) with customers seeking to book appointments. The Service facilitates the scheduling process but does not itself provide any beauty, grooming, or other services.

We act solely as an intermediary platform. All services booked through TreatsMe are provided by independent third-party businesses, not by TreatsMe.

3. User Accounts

To use certain features of the Service, you may need to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your login credentials confidential
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized access

You must be at least 16 years old to create an account and use the Service.

4. Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• That the Service will be uninterrupted, timely, secure, or error-free
• That the results obtained from use of the Service will be accurate or reliable

We do not warrant that the Service will meet your requirements or expectations. Your use of the Service is at your sole risk.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TREATSME AND ITS OPERATORS, DEVELOPERS, AFFILIATES, AND THEIR RESPECTIVE OFFICERS, EMPLOYEES, AGENTS, AND SUCCESSORS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or business opportunities
• Any damages arising from your use or inability to use the Service
• Any damages arising from the conduct of third parties, including service providers using our platform
• Any damages arising from unauthorized access to your account or data
• Any financial losses, including but not limited to lost business, lost customers, or payment disputes

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED EUROS (€100), WHICHEVER IS LESS.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

6. Third-Party Services

TreatsMe is a platform that connects customers with independent service providers. We are not responsible for:

• The quality, safety, or legality of services provided by businesses using our platform
• The accuracy of business listings, descriptions, or pricing
• Any disputes between customers and service providers
• Any injury, illness, or damage resulting from services booked through our platform
• Cancellations, no-shows, or scheduling conflicts
• Payment disputes between customers and service providers

All bookings and transactions are between you and the respective service provider. We encourage you to review the terms and policies of any business you book with.

7. User Responsibilities

By using the Service, you agree not to:

• Use the Service for any unlawful purpose
• Impersonate any person or entity
• Submit false, misleading, or fraudulent information
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use automated systems to access the Service without permission
• Harass, abuse, or harm other users or service providers
• Violate any applicable laws or regulations

8. Indemnification

You agree to defend, indemnify, and hold harmless TreatsMe and its operators from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit through the Service.

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including if you breach these Terms.

You may terminate your account at any time by contacting us at [email protected]. Upon termination, your right to use the Service will immediately cease. Upon your request, we will delete all your personal data in accordance with our Privacy Policy.

10. Free Service

The Service is currently provided free of charge. We reserve the right to introduce paid features or modify pricing at any time. We will provide reasonable notice of any changes that affect your use of the Service.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable laws of the member state where the operators are located, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the competent courts in the European Union.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

14. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and TreatsMe regarding your use of the Service and supersede any prior agreements.
